1. Contract Formation

By placing an order for clothes, notebooks, or shoes ("Products"), you enter into a binding agreement with The Nymph Anthology. The contract is formed only when we send you an email confirming the shipment of your Products.

2. Pricing, Taxes, and Duties

  • Pricing: All prices are as displayed. We reserve the right to correct pricing errors.

  • Sales Tax/VAT/GST: Prices include VAT/GST where required by law (e.g., UK, Australia, NZ, Turkey) unless stated otherwise.

  • Import Duties: For international orders (e.g., shipping to Japan or Switzerland), you are the "Importer of Record" and are responsible for all customs duties, taxes, and clearance fees.

3. Shipping and Delivery

We aim to meet estimated delivery dates, but they are not guaranteed. Risk of loss and title pass to you upon delivery to the carrier (US/Canada) or upon physical delivery to you (UK/AU/NZ/TR/CH/JP).

4. Returns and "Right of Withdrawal"

  • The 14-Day Rule (UK, Switzerland): Residents in these regions have a legal right to cancel an order for any reason within 14 days of receipt.

  • Global Returns: Products must be unworn (shoes/clothes) and in original packaging.

  • Exclusions: Personalized or "Final Sale" items are non-returnable unless defective.

5. Warranty and Liability

  • Standard Warranty: We warrant that Products will match their description and be free from manufacturing defects.

  • Limitation: To the maximum extent permitted by law, our liability is limited to the purchase price of the Product.

6. Regional Specific Provisions

The following terms override the sections above for residents of these specific countries:

United States (US)

  • Arbitration: All disputes shall be resolved by individual binding arbitration. You waive your right to a jury trial or to participate in a class action.

  • Disclaimer: Products are provided "as is" without any express or implied warranties of merchantability, except as prohibited by state law.

Australia & New Zealand (AU/NZ)

  • Consumer Guarantees: Our Products come with guarantees that cannot be excluded under the Australian Consumer Law or the NZ Consumer Guarantees Act. You are entitled to a replacement or refund for a "major failure."

Japan (JP)

  • Anti-Social Forces: You represent that you are not a member of an organized crime group (Boryokudan) or any "Anti-Social Forces." We may terminate any contract immediately without notice if this is breached.

Canada (CA)

  • Quebec Residents: Specific consumer protection laws apply. Any limitations on legal warranties or liability that are prohibited by the Quebec Consumer Protection Act do not apply to you.

7. Governing Law

.3 Provisions Applicable to Consumers Residing in Switzerland. For orders shipped directly to Switzerland, the contractual relationship is governed by the warranty rules of the Swiss Code of Obligations (Articles 197 et seq. Warranty Period: In departure from regular statutory options but in alignment with cross-border benchmarks, we grant a warranty period of two (2) years for new physical goods, running from the calendar date of delivery. For explicitly marked second-hand or refurbished goods, the period is limited to one (1) year. If the consumer would like an item repaired the warranty becomes 2+1 years.

Mandatory Inspection and Notification Obligation (Mängelrüge): Under Swiss law, you are legally obligated to inspect the delivered items immediately upon receipt. Any obvious defects, transport damages, or incorrect shipments must be reported to our Customer Support team in writing (via email or our dedicated platform form) within five (5) business days of delivery. Hidden defects that emerge later must be reported immediately upon discovery. Failure to report defects within these periods shall be deemed legally binding approval of the goods, causing an immediate forfeiture of your warranty rights.

Remedy Selection Policy: In modification of the default provisions of Article 205 OR, your remedies are structured as follows: The choice of remedy rests primarily with us. We will systematically prioritize a free-of-charge repair or a faultless replacement of the item. A reduction of the purchase price (Minderung) or full rescission of the contract (Wandelung) can only be requested if a repair or replacement is logistically unfeasible, has repeatedly failed, or is disproportionate in cost.

.4 Common Exclusions (All Jurisdictions) Warranty and legal guarantee protections do not cover defects, faults, or damages resulting from:

Normal wear and tear or natural degradation of consumable parts (e.g., batteries, protective coatings) unless caused by a defect in manufacturing;

Accidental damage, misuse, neglect, improper storage, or exposure to environmental extremes;

Unauthorized repairs, modifications, or physical alterations executed by third parties not approved by us;

Failure to operate the items in accordance with the provided manufacturer manuals and safety guides.

.5 How to Initiate a Claim To file a claim under your regional framework, please contact our support desk at lesnymphes@gmail.com or navigate to your account dashboard. You must supply your order confirmation token, a detailed explanation of the defect, and clear digital photographic or video evidence of the fault. If a physical return is authorized, we will issue a prepaid shipping label. Unauthorized returns will not be processed and shipping fees will not be reimbursed.

Switzerland: Quality Warranty & The "2+1" Rule

  • The Extension: If you opt for a Repair, the warranty period for that specific product is automatically extended by an additional 1 year, giving you a total of 3 years of coverage from the original date of purchase.

  • Failed Repair: If a repair is unsuccessful, you retain the right to a full replacement or a price reduction.

3. Footwear & Apparel Specifics

4. Claim Process for Switzerland

To initiate a warranty claim in Switzerland:

    UK Quality Guarantee & Warranty

1. The 2-Year Guarantee UK Customers

For our UK customers, we provide a two-year guarantee against manufacturing defects.

First 6 Months: If a fault appears within the first six months, it is presumed to have existed at the time of delivery unless we can prove otherwise. We will repair or replace the item at our expense.

6 Months to 2 Years: If a fault appears after the first six months, you may still be entitled to a repair or replacement, provided you can demonstrate that the fault is a manufacturing defect rather than the result of regular use.

2. Manufacturing Defects vs. Fair Wear-and-Tear

It is important to distinguish between a product that is "faulty" and a product that has reached the end of its natural life through use.

What is covered (Manufacturing Defects):

Footwear: Splitting of the sole (where not caused by sharp objects), failure of eyelets/hardware, or stitching failure on the upper.

Clothing: Premature seam failure, non-functional zippers (upon arrival), or significant fabric defects.

Notebooks: Binding failures or missing pages.

What is NOT covered (Fair Wear-and-Tear):

Friction & Abrasion: Holes in the toes of shoes or "pilling" of fabric in high-friction areas (like between the thighs or underarms).

Heel Wear: Natural erosion of the shoe heel or sole caused by your walking gait.

Washing & Care: Shrinkage or fading caused by failing to follow the care label instructions (e.g., washing a "cold wash" item in hot water).

Accidental Damage: Scuffs on shoe leather, snags in fabric from jewelry/velcro, or water damage to notebooks.

3. How to Make a Claim

If you believe your item has a manufacturing fault:

Stop using the item immediately to prevent further damage.

Note on POD Products: As your items are printed on demand, slight variations in print placement or minor "ink scents" from the curing process are normal and are not considered manufacturing defects.
